These Terms of Sale govern all purchases made through www.zanypig.co.uk (“Our Site”). By placing an order, you agree to these Terms of Sale. They should be read together with our Delivery, Returns and Refund Policy, Terms of Use, Privacy Policy, and Cookie Policy.
1. Orders
Orders are placed through Our Site by following the checkout process.
You will receive an order confirmation email once your order has been submitted.
We reserve the right to refuse or cancel any order if:
- the goods are unavailable,
- there is an error in pricing or description,
- payment cannot be authorised, or
- we reasonably suspect fraud.
If we cancel an order, any payment taken will be refunded promptly.
2. Pricing and Payment
- All prices are shown in GBP (£) and include VAT where applicable.
- Payment methods accepted: Stripe (secure checkout), Clearpay, PayPal, and other options shown at checkout.
- Payment is taken at the time of order placement.
- If a pricing error is discovered, we are not obliged to supply goods at the incorrect price. You will be notified and given the option to proceed at the correct price or cancel for a full refund.
3. Delivery
- Delivery is governed by our Delivery, Returns and Refund Policy.
- Risk of loss or damage passes to you once the parcel is delivered, including delivery to a secure location if requested or chosen by the courier.
- Delivery timeframes are estimates unless you select Guaranteed Next Day Delivery.
4. Returns and Refunds
- Returns and refunds are governed by our Delivery, Returns and Refund Policy.
- You may cancel or return your order within 30 days of delivery.
- Refunds will be issued to the original payment method only.
- PayPal refunds exclude the original PayPal fees.
- Delivery charges are refundable only if goods are faulty or we made an error.
5. Faulty or Damaged Goods
- If goods arrive damaged or faulty, you must notify us within 3 days of delivery with photographs and a description of the issue.
- Damaged items must be returned within 30 days for assessment.
- Remedies may include repair, replacement, or refund. Refunds or replacements will be processed within 14 days of receiving the returned items.
6. Cancellation by Us
We may cancel an order before dispatch if:
- goods are unavailable,
- there is a pricing or description error,
- payment cannot be authorised, or
- fraud is suspected. Refunds will be issued promptly if cancellation occurs.
7. Customer Responsibilities
- You must ensure that the delivery details provided are accurate and complete.
- If you request delivery to a secure location (e.g., porch, back gate), responsibility for the parcel passes to you once the courier confirms delivery.
- If you do not wish for delivery to a secure location, please ensure someone is available to receive the parcel.
8. Limitation of Liability
- We are not liable for indirect or consequential losses, including loss of profit, goodwill, or business opportunity.
- Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence.
- Your statutory rights as a consumer are not affected.
9. Alternative Dispute Resolution (ADR)
If you have a complaint, we recommend contacting us first so that we can resolve it directly. If necessary, you may pursue a resolution through a recognised UK ADR provider. Details are available in our Delivery, Returns and Refund Policy. This does not affect your statutory rights.
10. Law and Jurisdiction
- These Terms of Sale are governed by English law.
- Consumers benefit from mandatory provisions of the law in their country of residence.
- Disputes will be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, depending on residency.
- Business users agree to the exclusive jurisdiction of the courts of England and Wales.
